Terms of Service

Effective September 5, 2026

These Terms of Service ("Terms") are a binding agreement between you and Perez Capital Group LLC, a Wyoming limited liability company ("Sayble", "we", "us"), governing your access to and use of the Sayble applications, websites, and services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Beta status

The Service is provided as a beta. Features, availability, performance, and pricing may change, and the Service may contain errors. We may modify or discontinue features at any time.

3. Your account

You are responsible for your account, your credentials, and all activity under your account. Keep your password confidential and notify us of any unauthorized use. You must provide accurate information and keep it current.

4. Acceptable use

You agree to use the Service lawfully and in accordance with our Acceptable Use Policy, which is incorporated into these Terms. You must comply with all laws applicable to your conversations, including recording-consent and privacy laws in your jurisdiction and the jurisdiction of others on your calls. You are solely responsible for obtaining any consent required to record, transcribe, or process a conversation.

5. AI: no guarantee of accuracy or outcomes

The Service uses artificial intelligence to generate suggestions. AI output can be inaccurate, incomplete, or inappropriate. You are responsible for reviewing all suggestions and deciding what to say or do. We do not guarantee any business, sales, hiring, financial, or other outcome, and nothing in the Service is professional, legal, financial, or employment advice. See our AI Disclosure.

6. Your content

You retain all rights you already hold in the content and conversation information you submit ("User Content"). You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display User Content solely to operate and improve the Service and to provide it to you. We do not claim ownership of your User Content. You are responsible for your User Content and represent that you have the rights necessary to submit it.

7. Feedback

If you give us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.

8. Our intellectual property

The Service, including the Sayble name, logo, software, user interface, and content we provide, is owned by us or our licensors and protected by law. Except for the rights expressly granted to you, we reserve all rights. See our Copyright / IP Policy.

9. Third-party services

The Service relies on third-party providers (for example, cloud hosting, payment processing, and AI model providers). We are not responsible for third-party services, and your use of them may be subject to their terms.

10. Payments, trials, subscriptions, and cancellation

Paid plans are billed through our payment processor, Stripe. Before you confirm a purchase, we show you the plan, price, currency, billing period, trial length, renewal amount and date, and how to cancel.

  • Trial: Paid plans begin with a 3-day trial. A payment method is required to start the trial. You are not charged during the trial.
  • Auto-renewal: Unless you cancel before the trial ends, your subscription begins automatically at the stated price and renews each billing period until you cancel.
  • Billing periods: Sayble is offered on a monthly plan and an annual plan. The plan, price, and billing period are shown before you confirm, and your chosen period renews automatically at the same price until you cancel.
  • Annual plans: An annual plan is paid in advance for twelve (12) months and renews annually. Before each annual renewal we will send a reminder to your account email, at least 15 and no more than 45 days in advance, stating the renewal date, the renewal amount, and how to cancel. You may cancel at any time before the renewal date to avoid the next charge.
  • Founder pricing: Where a founder or creator rate is applied to your subscription, it is applied through your payment processor at checkout, and the rate and its duration are shown to you before you confirm. We will not increase the price of an existing subscription without notice and an opportunity to cancel.
  • Cancellation: You may cancel anytime from Account → Manage subscription. Your access continues to the end of the paid period.
  • Taxes: Prices exclude taxes unless stated; you are responsible for applicable taxes.

11. Refunds

Except where required by law, payments are non-refundable. If you believe you were charged in error, contact billing@trysayble.com and we will review in good faith.

12. Termination and suspension

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or for prolonged inactivity, with notice where practicable. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR ACCURATE. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising out of or relating to the Service; and (b) our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (i) the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or (ii) US $100.

These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these Terms limits liability that cannot be limited by law.

15. Indemnification

You will defend, indemnify, and hold harmless Perez Capital Group LLC and its officers, employees, and agents from any claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including recording-consent and privacy laws.

16. Dispute resolution; arbitration; class-action waiver

Please read this section carefully — it affects how disputes are resolved.

  • Informal resolution first. Before filing a claim, you agree to contact us at legal@trysayble.com and try to resolve the dispute informally for at least 30 days.
  • Binding arbitration. Except for the exceptions below, disputes arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, to the extent permitted by applicable law.
  • Class-action waiver. To the extent permitted by law, disputes will be conducted only on an individual basis and not as a class, consolidated, or representative action.
  • Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property or unauthorized-use claims. Nothing here waives rights that cannot be waived under applicable law, and where arbitration or a class waiver is not enforceable, that portion is severed.

17. Governing law

These Terms are governed by the laws of the State of Florida, USA, excluding its conflict-of-laws rules, except where mandatory local law applies to you.

18. Changes to these Terms

We may update these Terms. We will post the updated version with a new effective date and, for material changes, provide notice or require renewed acceptance where legally appropriate. Your continued use after changes take effect means you accept the updated Terms.

19. Miscellaneous

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms are the entire agreement between you and us regarding the Service.
